    First off saying that there are not enough warning sighs just makes me sick. Thoses of us that have been on TOT know all about the warning signs that they have. And second why after 3 years? Why did she wait so long. Like I said I feel bad that this happened to her but it is not Disney's fault.

    I understand this young lady is a minor but from the story it is difficult to ascertain if she has the cognitive ability to file a lawsuit on her own behalf.

    Typically if you have a hypoxic brain injury that leaves you without speech or mobility there is some measure of cognitive disability as well.

    The article says she & her mother filed the suit implying she is acting on her own behalf with her mother.

    This is indeed a tragic situation she appears to be a lovey girl in the picture. However that being said that has nothing to do with the merits of the case.

    I'm not at all sure what they mean by "common carrier". To me that would mean public transportation that has no restrictions on who rides, like a bus.

    Unfortunately we all pay the price for ongoing lawsuits that are beyond the realm of reason. It's not that we can't live without things like theme parks & thrill rides. Unfortunately just closing thrill rides or even an entire park isn't where it ends it's in every aspect of daily living. This is part of the reason we pay so much for seemingly nothing items, the cost of potential lawsuits is factored in.

    I've said repeatedly that lawsuits are no longer just a way to right a wrong, they are a way to make a living for all to many. This is making it increasingly difficult for folks with legitamate suits to even get into court in a timely manner(if @ all) much less get a fair settlement.

    We are a world of victims anymore, someone or something is always to blame when something bad happens to us. No one has to be responsible for their own actions anymore. It's to the point that we are becoming desensitized to true injustice.

    It's like watching graffic content all the time. We tend not to react to true gore.

    I'm sorry this happened to this young lady and her family. If somehow Disney is a fault they should pay but they are going to have to come up with something more than the # of warnings or lack of restraints.

    Oh & why so little someone mentioned. This is a rather miniscule amount esp after the lawyers get their chunk. On the surface it would appear there is much more to the story. Her arrest was witnessed & ACLS(Advanced Cardiac Life Support) was available to her immediately. This implies that the brain was supplied with oxygen @ the moment of the event by the ambulance crew administering lifesaving measures with O2. Since there was no delay that could be blamed on WDW my guess is the family if most likely sueing the medical providers as well.

    I'm not being cynical or mean towards the family. This is from yrs of experience & observation of sequence of events when medical isssues are concerned. I could be wrong which would leave me scratching my head as well to the amount. Perhaps their lawyers feel Disney will offer them more just to make this go away.

    I guess the courts will decide this. Asking for such a small amout of money seems like they are asking for an out of court settlement. I know they have socialized medicine in the UK, but I would think one would start a little higher for a permanent disability.

    I agree... I think the only thing more they could do is hand out the mandatory read-me cards like they do on Mission Space... I haven't actually counted the times but I would argue that there is at-least 6 warning signs for the attraction...

    I do think its odd that two of the lawsuits right now are for both extremes.. One TOT cures, one TOT injures...

    I have NEVER heard of a teenager have a heart attack that there wasn't either an unknown preexisting heart problem or drugs involved. With this teen I would imagine it to be a congenital heart defect.
