Fox hasn't been anything more than the distributor for the Star Wars films for a long time. They did originally own the copyright on the first film, but they gave that up as part of the negotiation for the rights to distribute the prequel trilogy. Remember that Lucas made one of the greatest deals in movie history. When "American Graffiti" ended up as a surprise hit, he decided not to use his newfound leverage to negotiate a bigger salary on "Star Wars". Instead, he asked Fox to let him retain all sequel rights, trademarks and ownership of the characters, and the merchandising rights. Fox gave him those things, believing they were essentially worthless and that they had negotiated a great deal. The merchandising rights alone allowed Lucas to self-finance the sequels, eventually culminating in this deal where he was able to sell it to Disney with minimal encumbrance. -Jeff
