From the looks of it, the basket is donut shaped, and the teather goes right up through the middle of it to the balloon. The basket then hangs off the balloon and is completely seperate from the teather. I think the wind problem is similar to that with DL's Remember fireworks, where the wind at higher altitudes is often much higher than on ground level. While it might not seem that bad on the ground, there could very easily be large gusts at 400 ft that could cause a pretty scary ride.
