The question is not whether you can "get away with it", but whether it is the right thing to do. The fast pass is good from the starting time on the pass until the end of the day. If you miss out on using it, just get a new fastpass the next morning. You don't have to wait to use it before you can get another pass either, in case you didn't realize that. Once the start time of the pass has been reached you can get another fast pass on that or any other ride in the system. Also, certain rides (maybe Roger Rabbit?) are on a different fast pass system, so you can get a fast pass for them even when your other fast pass hasn't gotten to the start time yet.

Besides, if the ride is down and you have a fastpass, I am pretty sure that if you see a CM they will issue you a pass for the next day. If you don't see one go to guest relations and tell them about it and the chances are they will give you the whole park, that seems to be the Disney way lately.
