Sen. Kennedy trying a "last gasp" block of Alito

    THE DRUDGE REPORT has obtained a complaint filed by H. Gerard Heimbecker of Upper Darby, PA accusing Alito of not properly listing the Heimbecker v. 555 Associates case in his Senate questionnaire.

    Kennedy legal aide James Flug is behind the efforts to push this latest attack. The veteran aide has been criticized for Sen. Kennedy's misfires during the Alito hearing last week. Flug was reportedly behind the attacks Kennedy used against Alito related to the Concerned Alumni of Princeton (CAP) and Vanguard recusal case.

    In the 2004 case, Heimbecker not only filed a request for Alito to recuse himself but also the entire Third Circuit as well.

    One Capital Aide aware the situation challenged Heimbecker's credibility. "The individual who filed this complaint is clearly a serial litigant. It will be interesting to see how far the Democrats will push this and what the mainstream media will make of it." <<

    So if a Senator wants to ask Alito the tough questions, the obvious thing to do is attack the Senator personally. Kennedy has a checkered past, so that means that Alito is qualified for a lifetime appointment without any debate.

    I think he killed a woman and because he is a Kennedy he got away with it. So I don't think he is in any shape to challenge any ones integrity.

    Still, if the Democrats are to save face with their more liberal constituents, they need someone to "take one for the team" so they can't be accused of selling out. Kennedy is the one that's been chosen to take the hit. Why not? He will always be re-elected in Massachusetts and he is totally irrelevant to the rest of the country, so he's a natural.

    Alito gets confirmed, and the Democrats have an old warhorse the can trot out if they get flack from the left about selling out. Everybody’s happy.

    RT, you're preaching to the choir with me. I've said all along Alito is going to get confirmed. Ideology aside, he's eminently qualified for the job. Some conservative moonbats here aren't happy unless they can try and stir up a bogeyman at every turn, however.

    So far, 9 Democrat Senators have gone on record as saying they'll vote against Alito. Only one has said he'll vote for confirmation.
