tom s. island security.......

    Security has always been on Tom Sawyer Island, but with the fact it is closing on January 15th for a remodel and retheming, more security has been placed on the island to prevent folks from "collecting" souvenirs.

    If you were caught, more than likely you would be escorted off property, and given a notice to not return (aka Trespass). If they knew you had an AP, they would give you a credit if you only used it a couple of times, but most folks would have it revoked with no type of refund.

    Disney could also decide to file charges for theft if they felt it was for profit.

    Considering taking part of the disneyland scenery (whatever sign it may be that you found) is considered theft, I wouldn't advise you to take anymore signs/scenery no matter where you are in the park and no matter where you find them. Security is always watching you all over the park and you will wind up in the disneyland jail or thrown out of the park. sometimes "memorbilia" like this from the park just isnt worth it. unless you want to end up not being allowed back into the park.





    and yes it has been CONFIRMED that there is a disneyland jail =)

Generally speaking, most AP's who get caught stealing things have used their AP more than a few times so there is no credit due. If you were unlucky, you could have been arrested for trespassing, burglary, breaking and entering, and petty theft. I am sure there are other things they could throw in there, but those are the usual ones if one is going to be arrested for stealing. And yes, it's still breaking and entering even if it's just on an island. The "breaking" that's done can be an invisible plane into an area of property where the theft takes place. No window or door breaking necessary...

    Security appeared out of no where in a blink of an eye. Yes, there is a jail. Yes, he was escorted DOWN MAIN STREET to the exit and kicked out.

    Needless to say, we broke up shortly after that.

    Burglary would be a bit of a stretch, as they'd have to prove that you formed the intent to steal the sign before the trespass began.

    The legal theory at work here is that had Disney known what you intended to do up front, they would have denied you permission to enter. But trespassing would more directly apply to getting caughtg in any "off limits" area in the park.

    A burglary is a trespass combined with a theft. If the intention for the theft occurs after entrance, then it's just a theft, but if it occurred before entry, than it's the much more serious crime of burglary. Of course, the prior intent would need to be proved in order to prove burglary. The only situation that I know of where this comes up in practice is for shoplifting. If you get caught shoplifting and you have no money or other means to pay on your person, then it can be assumed that you went into the store with the intent to steal the item, as you had no way to buy it, and they could potentially pop you for burglary. But if you have money in your pocket, then the shoplifting could have just been on the spur of the moment. I have no idea how often burglary gets prosecuted for what most people would think of as shoplifting - perhaps they just use this as leverage to get you to plead guilty to shoplifting.

    Yes, the burglary charge is usually added when the Guest goes from store to store, not just in one place. This justifies the burglary charge because it's clear that the person enters with the intent of stealing, rather than just going in first and then deciding to steal. I also have witnessed that the more belligerent a person is when they are caught shoplifting the more likely they are to have a burglary charge attached by Disneyland (assuming the intent can be reasonably proven). Generally it's just trespass and petty theft and they go along their way with a citation from the Anaheim PD with a request not to return to the property that day. And, as SuperDry wrote, if the person has no money to pay then it can also be assumed that they went in with the intention to steal. For an outdoor thing like the TS Island area where things are not available for purchase to being with it would be much harder to get that charge to stick.
