Originally Posted By Darkbeer San Diegans for the Mount Soledad National War Memorial Present Signed Petitions to Save the Cross and Plaques SAN DIEGO--April 7, 2005--"San Diegans for the Mount Soledad National War Memorial" today presented to the San Diego City Council petitions signed by 89,237 San Diego residents, insisting the Council reverse its March 8, 2005, decision which declined the United States Government's offer to accept transfer of title to the Mount Soledad Veterans War Memorial property. San Diegans for the Mount Soledad National War Memorial is demanding that the City Council reverse its decision and turn the site of the memorial, with its plaques and historic cross, into federal property where the cross will serve a secular purpose as part of a national war memorial protected under the Constitution of the United States. Phil Thalheimer, chairman of San Diegans for the Mount Soledad National War Memorial, noted, "The San Diego City Council has let down the people of San Diego and it's time they set things right. The people have spoken again and again. They want this important 50-year symbol of San Diego's heritage with its plaques and cross to be protected. Transferring the property to the federal government will accomplish that." The fate of the Mount Soledad Cross has been in question since 1991, when a federal court ruled the presence of the cross on public property violated the California Constitution. To cure the violation, the City sold a portion of parkland surrounding the cross to the Mount Soledad Memorial Association. The City Charter requires that such a sale of parkland be authorized by a two-thirds vote of the electorate. The citizens of San Diego provided this authority in 1992 when 76 percent of the voters approved Proposition F, which authorized the City to sell a portion of Mount Soledad to maintain the historic war memorial. The federal court subsequently found that the sale of the property to the Association violated provisions of the California Constitution prohibiting government support of religion. The City then conducted a second sale of parkland around the cross, this time by a competitive bid process. The Association was the highest bidder, and, after taking possession of the property, built a memorial composed of granite plaques honoring veterans. In a recent decision, the Ninth Circuit Court of Appeals ruled the conduct of the second sale to the Association violated the California Constitution. The decision also indicated the sale may be void and constitutional issues associated with the previous passage of Proposition F in 1992 may invalidate the proposition. On November 20, 2004, the U.S. Congress adopted H.R. 4818 (P.L. 108-447) to which San Diego Congressmen Duncan Hunter and Randy 'Duke' Cunningham attached language, which was signed into law by President Bush, authorizing the federal government to take over the control and protection of the entire war memorial in San Diego should the City donate the property to the federal government. The San Diego City Attorney concluded that the donation of the Mount Soledad Memorial property to the National Park Service would "be a religious purpose and as such be unconstitutional." The San Diego City Council subsequently voted 5-3 to block the transfer of the property to the federal government and instead remove its historic cross. Numerous community leaders of different political parties and religions have disputed the City Attorney's finding and railed against the ensuing council vote. In addition, according to a poll, commissioned by the Republican National Hispanic Assembly, 71 percent of registered voters in the City of San Diego disagreed with the council's vote; they want the Mount Soledad Memorial to remain as is, with its cross in place. San Diegans for the Mount Soledad National War Memorial organized on March 11 to galvanize the public and city officials to support donating the land and cross to the federal government. Volunteers have collected tens of thousands of signatures across the city as part of a referendum. If the City Council chooses not to reverse its vote, the group plans to seek a special election for another vote of the people. For now, they plan to meet with those council members who voted against the transfer, in hopes of reversing their votes.
