I have a trading card from Series 2 of the Disney Treasures card set that depicts that scene (Series II was a continuation of the Heroes & Villains lineup and was also focusing on Donald).

I think the main reason why Cheshy is considered a Villain is because he got Alice in trouble at crucial times with HRM the Queen of Hearts: -During the croquet game, he was talking to her and disappeared when the Queen asked her to whom she was speaking with. Then he takes it further by making her flip herself in the air. -During the trial as Alice is shrinking, she calls the Queen a "fat, pompous, bad-tempered old tyrant". The Queen, relishing that Alice is back to a normal size, asks her to repeat herself and the Cheshire Cat does so with glee (and even adding a laugh), causing one of the great chases in Disney animated films, along with Ichabod/Horseman and the tournament aftermath in Robin Hood...which was taken from Alice to begin with: the chase through the maze and the tournament tents are similar.
