The feeling is that it is cheaper in the long run than litigation and a possible huge court settlement. Plus Disney is finding that juries are not as Disney friendly as they once were. I have been witness to a couple of major accidents on property in which legal was there greeting guests and offering free vactions in lieu of giving up any further legal claim. Many guests, unless they are seriously injured, are more than happy to get a free vacation on Disney and by talking to them early they dont give them much time to think about the fact that they are signing away any further claims. If a guest refuses to sign, Disney will continue to negotiate with them. I know once guest who was injured recieved 3 weeks at a resort, plus tickets, plus food that could be used over 5 years. We always knew when that person was on property because we were told to be especially nice and accomodating.

What it usually means is that if you go back, they will upgrade you, put presents in the room, even heard of Mickey visiting someone when they were "making it up". I am definately not an apologist, and probably haven't been in about 5 - 10 years. But Disney does tend to make good.
