It's possible the OP doesn't have the means at hand to post pics also. Not everyone has a digital camera, or a scanner.

At Disneyland the Health Services CM's provide care on site as well as contacting paramedics if necessary. Transportation to the closest medical center will also be provided upon request even if an ambulance isn't called. Every situation is documented to the hilt, even calls for Guests feeling faint. I find it difficult to believe that if he was severly injured and remains in pain that the Company won't contact him.

I don't claim to know the truth in this particular situation, but from my experience an injury gets documented and followed up. In fact, legal usually gets a call at the time of the incident depending on the severity (not for a faint Guest obviously, but a serious injury occuring on property, Disney's fault or not).

Back on focus: After two weeks of patient attempts to get just one return call, Disney has responded -- with a little nudge from various news sources. Thank you particularly to Orlando Sentinel for your valuable assistance in these efforts. Here is the explanation offered by a Susan Shiver, who represented herself as Guest Services Manager:

-- Pursuant to conversation with engineers, the lap bar is not a safety measure. It is not meant to be a safety restraint and has no function as a safety restraint. The lap bar is merely a deterrent to guests from exiting the ride vehicle when it makes stops within the attraction, for example, to switch tracks. There are no redundant safety features. There are no backup safety features. Nor are the ride cars signaled to halt if something goes wrong. --

They contend further that the mere inertia, the momentum of the ride is sufficient to keep riders inside the ride vehicle without a safety restraint. If an adult man has difficulty staying within the vehicle during motion without a restraint, how much more difficult might it be for a young teen or a small child of the size considered to be a safe rider by Disney to stay in the vehicle if the lap bar raises. Moreover, they state that, though it is “unlikely†a rider may be flung or fall out of the vehicle while in motion, it could happen.

Remember - it opens this spring! Experience the thrill of Everest for yourselves!
But if you do, make sure you or your child sit in the front seat and ride with the lap bar raised – then you will have a point of reference by which to make a meaningful contribution to these posts.

In Disney's response to your claim, they said that? And nothing about your own situation?

It ended up being nothing serious except a pain in my back for a few days, but regardless, I had always found the response of Disney to even slight injuries to be right on target (and even a bit overboard in my case).

You are either deliberately manipulating or misunderstood what she said. It's obviously a safety device, designed to, as you or she said, act as a deterrent and keep people from exiting the cars when they shouldn't.

<<They contend further that the mere inertia, the momentum of the ride is sufficient to keep riders inside the ride vehicle without a safety restraint.>>

This could easily be proven. The question is, would you be willing to accept the result if it was shown to be true?

That's funny. How do you prove something like this DIDN'T happen? Show pictures of lapbars properly down and locked?

BTW, my DH is an attorney (most of you here know that) and he always advises his clients to *never* speak about their cases (any kind of case), even to good friends or relatives. That, of course would include the internet community. So I assume that you're not going the "legal" route?

I agree with previous posters that cm's, on seeing any kind of medical distress of a guest, will go way way out of their way to encourage the person to seek medical treatment. I was just limping a little in MK one time and a cm came out of nowhere with a wheelchair for me. I'm surprised that you didn't get the name of the cm if you were unhappy with him/her.

I think that anyone with half a brain knows that there is a small probability that an accident can happen on any amusement ride, especially the mountains. Kinda like going to a baseball game and having a bat sail accross the seats and bop you on the head. I've seen it happen. Not fun, but it's a reality.

If someone feels they were insulted, then perhaps the justification of that is in your own postings. Our initial post was to warn the very people who would be most affected, should be most concerned and have the most clout -- Disney fans. This being very emotional, I failed at onset to simply come right out and ask for specific help initially, which resulted in an onslaught of misunderstandings and our being bombarded with insults from this Disney forum that has brought more attention than the forum realizes now. Advice precluded posting photographs. I have not had an abundance of time to review every post or respond individually, and I am unable to spend time defending any mis-perceived motives and just cannot respond to all the attacks. However, we still feel it important to keep everyone aware that this is not a ride considered by even Disney to have safety features. We were and are trying to get answers and valuable information because Disney fans are the only people who can make the changes necessary. As a stockholder, every year I vote against the board in order to implement improved ride safety checks and procedures. I always I felt like I was betraying Disney. I don't feel that way anymore.
