A court would basically have to decide what is more important, the ability of individuals to share videos and photos of their vacations, or the ability of Disney to have unreasonable control over people's vacation footage. Since video cannot replace actually riding Expedition Everest, for example, I don't see how high-definition videos of the attraction being traded are harmful to Disney. A lot of the dark rides don't show up well on video anyway.
