In cases of damage over a certain dollar amount, serious injury or death, the driver is automaticly tested. For Monorail drivers it would depend on if they are classified as public transportation or as a attraction ride.

I don't think parents should be faulted for letting children ride bikes in an area where Disney allows/encourages it. If this is a complete accident, then having a parent riding behind or in front wouldn't have made one bit of difference.
