It's similar to the fog that is made by those little fog making devices in some home water fountains. The puffer, however, uses a chemical based smoke. The water based mist would never be able to hold the "doughnut" shape for very long after it is expelled from the puffer device. And it's the chemical smoke that is not compliant with California's smog regulations. And sure, they could more actively intake the affected air and then filter it, but that would cost a tremendous amount more than in locations where they can just use the smoke and not worry about bureaucratic consequences. Disney never spends an inordinate amount of money in California to comply with special laws just to have an effect that they can implement elsewhere without all the extra hoops. They just omit the effect. Disappointing, but that's the way it is.
