She suffered third degree burns and had to have reconstructive surgery on her genitals. The woman did not receive millions. The settlement was reduced by the judge to $640,000. Then they settled for a confidential amount. The woman was found 20% at fault and McDonald's 80% at fault. She had originally tried to settle for $20,000, which was the exact cost of her medical bills and lost wages. Whether McDonald's was at-fault or not, she was not being greedy. Greed had nothing to do with her initial complaint. McDonald's and other fast food chains have settled with numerous other people who have been burned by hot coffee. She's dead now anyway. In any case, I would consider the issue resolved by the 7th Circuit Court of Appeals. Enjoying hot coffee, which is supposed to be kept at a temperature of 180-190 degrees according to some national coffee society, has inherent risks.

I hate cases like this, because they really are just stupid.

Is common sense no longer a valid human thought process? I do agree that McD's was at fault for serving scalding liquids but still, hot coffee...between you legs...in the car....things that make you go Hmm. OR, Here's Your Sign. >>>ANYTHING that is supposed to be served at a HIGH temperature (nachos, coffee, etc.) should assume that they are HOT.<<< As for the temp of the nachos, I didn't realize they were supposed to be served so hot that you couldn't pretty much eat them without waiting for them to cool. Maybe my love of the jalapeno's have dulled my heat receptors, lol -or- ole!
