It always has been, because that is in the interest of justice. You want a punishment that is given someone to fit a crime. You don't want to have someone unduly punished for something, nor not punished enough based on the behavior they engaged in. This is why we have varying degrees of criminality to the law. Why is this necessary? Because sometimes people violate the law and there may be extenuating circumstances, and it's simply not reasonable that one type of crime be given the same degree of punishment as another, although similar crime. Things aren't just black and white up or down. There are many grey areas involved, and the law tries to take that into account. That's why you have laws such as "use a gun, go to prison." You can rob a bank, but if you do it with a gun, you get more time tacked on. It is the same crime, with the same outcome, but the extra circumstance makes it so that it is a bigger offense. This is why, also, when you get convicted of even first degree murder, you can either be sentenced to death or life in prison. All these things come into play when a case is prosecuted or a sentence is announced. That's how the law works, and has always worked.

My grandma was a designer for Fields for almost 40 years -- we do not recognize macy's -- but we do recognize Fields as you accurately described it. but yes it appears us ( and a few more )line the roads from Minneapolis to Chicago

We love him that way but what he is doing is an obomiation. We are worried that we wont have great grand children to.

You don't really want him to pretend to love a woman and create a family with her that is almost doomed to end in divorce? Do you really want him to marry a woman just to make his family happy and in the process make himself extremely unhappy? Do you think God would want him to marry a woman and have sex with a woman he doesn't love? Would God want him to pretend to love his wife, to lie to his wife, to trick her? I honestly can't believe that God wants people to live lies and to bring children right into the middle of them. And it's posts like #349 that make you seem suspicious.

Matthew Shephard is dead regardless of what caused his killers to kill him. It makes no difference if they killed him because they hated gays or they wanted to rob him so they killed him. Either way it's the same result, just a different motive. The motive doesn't matter, the crime matters. My other point is that hate is hate. If someone hates republicans so much they would kill one, how is that any different from someone who hates blacks, jews or gays? My point about some idiot killing Rush because they hated him for being a talk show host is valid. That killer would not get extra jail time for a hate crime where a person who kills Cristopher Lowell would possibly get a hate crime sentence. There is no consistency here. To watch people try and justify this lack of fairness is very telling.
