Fitzgerald concluded he could not get convictions (except purjury and obstruction for Libby) based on the very high bar the specific law regarding outing of agents requires, but a civil case claiming "harm" is a much lower bar. If Rove, Cheney, et al were looking to punish Wilson and Plame, what happened with Novak specifically may or may not be relevant, let alone the whole story. Whether or not Rove, Cheney et al meant to harm Wilson and Plame, I have no doubt that Wilson and Plame believe it, hence the lawsuit. Considering the lower bar of proof in a civil lawsuit (and the fact that Paula Jones set the precedent that even a sitting president can be sued even for actions that took place before he took office), this might - or might not - portend bad things for the principals. Wilson and Plame are probably hoping for an O.J. - skated on the criminal charges, convicted in the civil case.
