SanDiegokid, what you seem to be missing the point on is that it's nothing wrong for a man attracting another man to engage in sex, but what IS wrong is wanting to do it in a public place ;). THAT'S what the heart of the matter is about in terms of the charge.

Like someone explained it on a talk show today, 'cruising' is having sex in a public place, be it gay or straight sex. This is the same thing that got George Michael's arrested all those years ago. The place is supposedly well known for that sort of thing there, THAT'S why the cops were there in the first place. Imagine having a kid walking into that bathroom and grown people are having sex in a stall.

Again, the issue is NOT a Gay issue although admittedly there is an undercurrent that that's what its really targeting, but CLEARLY there is enough of a problem surrounding it if

    A. It happens so frequently, there is a STING OPERATION in place for it now.

    B. A Senator from Boise Idaho out of all places knows about the reputation in that bathroom to engage in it himself.

(And just for the record, I never even HEARD of this before until a week ago lol. I know about the 'mile high' club on airplanes of course and have been shot down on many occasions by girlfriends to join the club ;), but looking for Gay sex in bathrooms is something that just makes you go, 'WoW'. What will people think of next?)

    Uh huh.

And you've never had heterosexual sex in a public place?

    I know I have.

Anyone on this thread who has, go ahead and raise your hands, k?

But that's okay, cause it was with a GIRL right?

    Ah...now I see. ;)

YES, cops are necessary. Extremely so. We need them to protect the rest of us from truly evil people who are out to defraud us, steal from us, rape us, and kill us.

But what does a cop sitting in a toilet waiting to shame a closeted gay guy have to do with THAT?

    Nothing at all.

Like Jon said earlier, don't they have anything better to do?

Even the cop, in the interrogation session, said "hey, it's no big deal. you appear, you pay a fine, you're done".

Well, if that's true, why the heck go through this process at all? Obviously the guys they're out to nail aren't a hardcore threat to society...

Uh....yes, yes I have :D. Wow, I'm not even making it up lol. But dude, remember its STILL illegal!!! Just because you don't get CAUGHT doesn't mean its okay for straight people to have sex in the fitting room at the GAP anymore than it is for Gay people to do it in a bathroom....an AIRPORT bathroom out of all things no less lol.

To keep it to our favorite subject matter, how many people been BANNED for life at DL for having sex on a ride or something? I'm assuming they were all straight. I mean c'mon, if Craig met a guy at an airport and asked him back to his hotel, none of us would be here now. He did NOTHING wrong in that sense, but 'cruising' mean the guy is looking to getting it in on in an open space where kids, Christens and sex hatters are around ;). I mean there is defending an act and then there is defending an illegal one and like someone said on Larry King tonight, if people want to make public space sex legal, write to your Congressman, but until then its ALL illegal, gay or straight.

(Ironically, raise hand if people think Craig would never put his hand anywhere close to that bill ;D)

LOL, that's EXACTLY what I'm saying ;). Judging by your last post, I don't think you really understand the issue here. ASKING for sex in an open place is not illegal, its wanting to do it IN the open space is where you get into trouble.

And yes, its ALL based on intent. The guy obviously was doing some code that is known throughout the uh, Gay-pro-bathroom-sex community that is saying, 'So, you wanna sex with me in the stall.' That's the ENTIRE basis of the arrest, that the guy specially was looking to have sex in the bathroom and directly propositioned a cop for it. Man, if you still not even sure what the entire basis of the argument is about, you should read more about it before commenting.

It is ILLEGAL to have sex in an open space. Basically that's what the arrest was for. If you don't believe me, ask someone if they want to have sex at the local park somewhere and see what happens when a cop sees it ;).

WD, like my new buddy SDK just said, how is "wanting to do something" illegal?

Pretty freakin scary, huh? That's 1984 zone for sure!

(another reason why cops and all their powers are scary...I do not trust them)

Sure, but how many busts and stakeouts have you read about involving heterosexuals?

    Answer, none.

Reason, cops are out to persecute homosexuals.

The facts are on the table, folks. You're just not seeing them.

Man, I thought I was out of here. I gave you the 2by4 already Mr. X ;).

Well, that's simple, next time ask a COP if you can buy some drugs off of him or tell a female one who you think is a prostitute and ask to have sex with?

C'mon we are talking INTENT here. Yes, the guy was looking to have sex in a public bathroom, that's ILLEGAL, period. Are you saying the cop has to wait for him to pull his pants down to make a move? And once again, the guy gave Gay-bathroom-sex CODE, that was the entire point of that interrogation. The Senator knew what he was doing (I know, according to the cop, but c'mon, there is a reason the ENTIRE Republican base threw the man under the bus, they smelled a rat like the rest of us ;))

But remember it was a MISDEMENANOR charge anyway. Its not like the guy was going to prison over it. In the scheme of it, its a tiny, tiny crime. Hell you MAIL the guilty plea in lol so really its not a HUGE crime anyway.....unless you are a Senator whose entire life and career is shunning that sort of thing, THEN its a big deal ;).

    WRONG.

Neither of those examples is a crime unless you put money in the cops hand.

It's illegal to DO it, not to want to do it.

**Are you saying the cop has to wait for him to pull his pants down to make a move?**

I'm pretty certain most cops are way too homophobic to let things go that far but yes, that would be a crime.

**And once again, the guy gave Gay-bathroom-sex CODE, that was the entire point of that interrogation.**

And he never admitted to anything in that interrogation. To which the cop replied "I'm disappointed. You're lying. If you don't plead guilty, you'll be sitting in a cell".

Is it possible that the esteemed police officer was sending out all the signals that say "im looking for some action", such as sitting in the stall for an unusually long period of time, doing nothing that has anything to do with natures call?
The Senator merely asked by signal if the other fellow was interested, it in no way implies that he would have done anything illegal in a public place. He certainly could have planned to go somewhere private.
Ben Stein had an interesting take on a sunday morning news show, and he feels wholeheartedly that the Senator was entrapped. Stein is no dummy.
I have to agree with him, the senator was lured and trapped, and then intimidated and bullied into a premature confession!
Like it or not, this cops case has a bigger hole in it than the Titanic! A good lawyer would chew the guy up and spit him out.
Yes, the Senator may be a lousy hypocrite, but that does not mean he is not being railroaded here.
