    The law reads that you are taking it from the owner OR person in lawful possession there of with intent to never return it.
    If you take your car to a repair shop and then come back later without paying your bill or otherwise informing the repair shop then you have taken it from thr person in lawfol possession there of.
    try getting a conviction on that case.
