    This is a personal injury case. As such, the lawsuit may be based upon any or all of three theories of recovery (i.e. strict liability, negligence and/or breach of warranty). Florida law goes by the doctrine of comparative negligence so even if the plaintiff fails to exercise ordinary care, that doesn't let WDW off the hook. Sounds to me as if the widow has a good case.
